If Second-Hand Smoke Kills, Why Aren't Public Smokers Charged With Assault With A Deadly Weapon?

My father smoked for most of his life. That is, until the doctors told him he'd die if he didn't stop smoking. He quit cold turkey. He died a few years later of lung cancer. I've had chronic shortness of breath most of my life. Hmmm, is there a correlation between my dad's insensitivity and my breathing issues? I think back to all the thousands of times we were in the car or in the house and I'm sitting in a cloud of toxicity. I've just realized that I was a chain smoker by default from the age of, well, 1 day old up until my parents split up when I was 10!

In many areas, the stranglehold of the cigarette companies on the politicians has been broken and public areas are designated as smoke-free. Why? Because facts prove that second-hand smoke KILLS PEOPLE! Here's my question: If that's true... if second-hand smoke actually kills people... then why haven't laws been enacted where public smokers are charged with assault with a deadly weapon or public endangerment? Or for parents dumb enough to force their kids to breathe their disgusting toxic smoke, how about child abuse?

To borrow half a line from George Carlin, when someone asks me "Do you mind if I smoke?" I tell them "Not if you don't exhale!"
